Court Accepts Amicus and Enjoins Enforcement of Commission's Emergency Rule

A victory for the IL Business Community! The Court agreed to enter a TRO (Temporary Restraining Order) enjoining enforcement of the Commission's Emergency Amendment 9030.70 regarding COVID-19 pending preliminary injunction proceeding. Notably, the Order states that the Commission and anyone acting in concert with the Commission is enjoined from invoking and/or enforcing the Amendments in favor of or against any person or entity, specifically those persons identified in the Amendments. This means that the said Amendment is no longer enforceable pending a proceeding on the Preliminary Injunction. Moving forward, the Commission has until April 30, 2020 to file an answer to the Complaint for Injunctive Relief and a telephone status hearing was scheduled for May 4, 2020 for discussion on the preliminary injunction proceeding.
